What Are Custody Violations?

A divorced or separated parent could be found in violation of a custody arrangement if they refuse to follow the legally binding guidelines set forth by your original judge. Even if the other parent’s conduct is not prohibited in the custody terms, any action they participate in that interferes with the other parent’s relationship with the child could be considered a violation.

  • Preventing Visitation: A parent that willfully engages in activities that prevents the other parent from their parenting time is preventing visitation. These actions can include scheduling extracurricular activities that conflict with visitation, planning playdates, or not allowing the child to see the other parent.
  • Interfering with Communication: Any interference that hurts the parent/child relationship with the other parent is a violation. This can range from blocking emails or texts from the other parent to blocking phone calls.
  • Denying Visitation for Non-Payment of Child Support: While a parent who does not pay child support can face legal repercussions, they are still legally permitted to maintain the custody and visitation schedule. Any attempt of the other parent to bar access to the parent who cannot pay support comes with it’s own set of legal punishments.
